Encouraging foreign investment in new energy and other specific industries

In 2020, Foreign Investment Law of the People's Republic of China (hereinafter referred to as the "Foreign Investment Law") took effect, which implements a negative list for foreign investment. All foreign investment in industries not included in the negative list is welcomed. At the same time, China has also launched the Catalogue of Industries for Encouraging Foreign Investment, which will give more preferential policies to the industries listed in the categores.

According to Foreign Investment Law of the People's Republic of China Article 4, the state applies the administrative system of pre-establishment national treatment plus negative list to foreign investment. ‘Negative list’ means a special administrative measure for access of foreign investment in specific fields as imposed by the state. Entry regulations are a prerequisite, so checking whether the scope of business is on the negative list is the first step to enter the Chinese market.

Foreign investors need to match the industries they want to invest in China according to the list, which belong to (1) prohibited industries; (2) restricted industries; (3) encouraged industries. PKF China will assist investors to enter the Chinese market successfully.
